The North Carolina Association of Realtors®, NCAR, has updated the Forms that most NC Realtors® use in working with North Carolina home buyers and sellers and they are effective as of July 1, 2015. North Carolina Statute of Frauds requires any contract for the sale of real property to be in writing and these forms facilitate a NC real estate broker to do so. NC agents are allowed to fill in the blanks on approved forms, but they are prohibited from practicing law.
There is a 60 day grace period (until 09/01/2015) before the new forms must be used, but many Raleigh area agents are already using these forms and I have uploaded samples that are available for your review.
You may see samples of the most frequently used forms here: Sample NC Realtor Forms
A few forms have been eliminated and there are some new forms as well. As I share in my real estate classes, if one needs to accomplish something with an offer to purchase before or after it has become a contract, “we have a form for that”.
Old versions of the forms should not be used on NC real estate transactions taking place after the end of August 2015.
